Terms & Conditions of ToCa.Gg

These Terms & Conditions (“Terms”) govern your access and use of ToCa.Gg (the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, you must discontinue use immediately.

ToCa.Gg may revise these Terms at any time, and continued use means acceptance of updates. Please check back regularly for changes.

1. Eligibility

The Service is intended for individuals 18 years or older. By using ToCa.Gg, you confirm that you meet this requirement.
ToCa.Gg does not provide services to sanctioned countries or to individuals or entities subject to international trade restrictions, embargoes, or sanctions (including, but not limited to, Cuba, Iran, North Korea, Syria, and regions of Ukraine under sanctions).

2. Acceptance of Risk – Tokens and Digital Assets

Trading of ToCa.Gg tokens is at your own risk. ToCa.Gg is not responsible for any losses, including but not limited to: market volatility, trading mistakes, system failures, wallet compromise, or unauthorized access.
Blockchain transactions are irreversible, and ToCa.Gg cannot reverse, cancel, or refund them.
You are responsible for ensuring your wallet is properly connected and funded, including payment of gas fees, transaction fees, and applicable taxes.

3. Rewards, Benefits, and Delivery

ToCa.Gg may provide rewards, entitlements, or promotional benefits (“Benefits”) from time to time.
Benefits are offered as promotional add-ons and not as standalone purchases. For example:
- “Every $20 participation may entitle you to a Benefit.”
- “You may earn an entry into our promotional reward system for each $20 commitment.”
Once a Benefit is redeemed and shipped, ToCa.Gg has no further responsibility. ToCa.Gg will not cover damage, loss, or delays caused by shipping providers or customs.
Users are responsible for shipping costs, taxes, and duties associated with Benefits.
All redemptions are final.

4. User Responsibilities

By using ToCa.Gg, you agree to:

Provide accurate and current information when registering or transacting.
Secure your wallet and account details; ToCa.Gg is not liable for unauthorized access.
Use the Service lawfully and not engage in:
- Fraud, scams, money laundering, or terrorist financing.
- Market manipulation, including “pump and dump,” wash trading, or false bidding.
- Circumventing controls or accessing the Service via unauthorized tools or bots.
Comply with all applicable laws in your jurisdiction.

5. Wallets and Transactions

To access digital features, you must connect a compatible blockchain wallet. ToCa.Gg does not store or control wallets or private keys.
All transactions are executed on the blockchain. ToCa.Gg cannot reverse or modify them.
ToCa.Gg does not guarantee that all tokens, NFTs, or assets will be available for purchase, sale, or transfer at any given time.
Trade activity may not be immediately reflected within the Service due to technical or network delays (e.g., websocket events may not record your buys in real time). Users are responsible for verifying their transactions directly on the blockchain.

Purchases made from any other liquidity pool or contract address will not be recognized or counted by ToCa.Gg, and such transactions are outside the scope of our Service.

6. Credits System

The Platform may allow you to top up credits (“Credits”) which can be used to access or pay for certain features and services.
Credits are a digital balance specific to ToCa.Gg. They are not legal tender, currency, securities, stored value facilities, or regulated payment instruments under Singapore law.
Credits have no inherent monetary value outside the Platform and do not accrue interest.
You may purchase or top up Credits through supported payment or swap methods.
All top-ups are final and non-refundable, except where required by applicable law.
You may withdraw unused Credits at any time via the Platform’s withdrawal mechanism.
Withdrawals are processed immediately unless delayed by network congestion, downtime, or external service provider issues.
We do not guarantee withdrawal times, but will make commercially reasonable efforts to ensure timely processing.
Credits can be spent within the Platform for eligible services, rewards, or features.
Once spent, Credits are deducted from your balance and cannot be reversed.
Credits are strictly non-transferable. You may not sell, gift, trade, or exchange Credits with other users or third parties.
Any unauthorized transfer attempt may result in suspension or forfeiture of your Credits without compensation.
You are solely responsible for monitoring your Credit balance.
Your Credit balance does not represent a deposit, bank account, stored value facility, or e-wallet.
You are solely responsible for all applicable taxes or duties arising from your use, withdrawal, or redemption of Credits.
We may revise these Credit Terms at any time by posting updated Terms on the Platform. Continued use of Credits constitutes acceptance of the revised Terms.

7. Marketplace & Auctions

ToCa.Gg may host a marketplace where users buy, sell, or auction digital assets.
ToCa.Gg is not a party to transactions between buyers and sellers (unless explicitly the seller). ToCa.Gg has no liability for disputes, non-payment, misrepresentation, or failure to deliver.
Auction rules:
- Bids are binding and final.
- ToCa.Gg may require proof of funds.
- Failure to pay within the stated timeframe may result in suspension or banning.

8. Drops, Randomized Packs, and Buybacks

ToCa.Gg may sell randomized digital packs (e.g., sealed packs containing cards).
The outcome of packs is determined randomly and cannot be influenced.
All sales of packs are final; no refunds or exchanges.
ToCa.Gg may offer a buyback option, but such offers are discretionary, limited in duration, and not guaranteed.

9. Taxes and Compliance

You are solely responsible for determining and paying any taxes, duties, or fees related to your use of ToCa.Gg, including income, value-added, and sales taxes.
Attempts to manipulate transactions for tax evasion (e.g., transferring assets between accounts at artificial values) are prohibited and may result in account suspension or reporting to authorities.

10. Intellectual Property

The ToCa.Gg platform, branding, content, and services are the property of ToCa.Gg or its licensors.
You are granted a limited, personal license to access and use ToCa.Gg for non-commercial purposes.
Unauthorized copying, resale, or exploitation is prohibited.
Any feedback or suggestions you provide may be used freely by ToCa.Gg without obligation.

11. User Content

Users may post or submit content (e.g., listings, comments).
By submitting content, you grant ToCa.Gg a non-exclusive, worldwide license to use, display, and distribute such content for the operation and promotion of the Service.
You are responsible for ensuring your content is accurate, lawful, and non-infringing.

12. Third-Party Services

ToCa.Gg may link to or rely on third-party services (e.g., wallets, marketplaces, payment processors).
ToCa.Gg is not responsible for third-party services and does not guarantee their performance.
Use of third-party services is at your own risk.

13. Risk Disclaimers

Digital assets and NFTs are inherently risky and volatile. ToCa.Gg does not guarantee authenticity, liquidity, or future value.
The Service is provided “as is” and “as available,” without warranties of any kind. ToCa.Gg does not guarantee uninterrupted access, error-free operation, or protection against cyberattacks.
ToCa.Gg has no responsibility for user errors (e.g., lost keys, mistyped addresses), third-party hacks, or blockchain failures.
Trade activity may not be instantly displayed or updated within the Service. Technical or network factors (including websocket delays) can cause a lag between your transaction and when it appears. Verification of all trades remains the sole responsibility of the user.

14. Limitation of Liability

ToCa.Gg is not liable for indirect, incidental, or consequential damages, including financial losses from trading or delays in delivery.
ToCa.Gg’s maximum liability in any case is limited to the greater of:
(i) $100, or
(ii) the fees ToCa.Gg retained in the transaction at issue.

15. Indemnification

You agree to defend, indemnify, and hold harmless ToCa.Gg from claims, damages, or losses arising from your use of the Service, your content, or violation of these Terms.

16. Arbitration & Dispute Resolution

Disputes will be resolved by binding arbitration on an individual basis, unless you opt out within 30 days.
Class actions and jury trials are waived.
Certain claims (e.g., intellectual property disputes) may still be brought in court.

17. Governing Law

These Terms are governed by the laws of the jurisdiction where ToCa.Gg is incorporated.
Any disputes not subject to arbitration shall be resolved in that jurisdiction’s courts.

18. Termination

ToCa.Gg may suspend or terminate access for violations of these Terms or unlawful activity. ToCa.Gg may also discontinue the Service at any time without liability.

19. Promotional Campaigns & User Benefits

ToCa.Gg may run promotional campaigns, reward programs, or benefit systems subject to additional rules.
Unless otherwise stated, no direct purchase is required to participate.
Benefits are provided as participation entitlements and do not constitute gambling, lotteries, or wagering.
ToCa.Gg reserves the right to modify, suspend, or cancel promotions at its discretion.
